Falsely Arrested by a Chandler Motorcycle Cop!!!

  Wednesday, January 18, 2012 just before 4:06 p.m. on Arizona Avenue and Warner Road a motorcycle pig failed to yield me the right of way to me and made a left turn and almost ran me over.

I was going north on Arizona Avenue and the motorcycle cop was going south on Arizona Avenue and making a left turn.

No big deal I just rode my bike around him.

But the piggy decided to arrest me and blame his traffic offense on me.

The piggy ordered me to go back to the side walk and accused me of not obeying the traffic signal that said "not to walk".

While I was in the middle of the street along with the motorcycle pig also being in the middle of the street the cop ordered me to go back to the sidewalk on the southeast side of Arizona Avenue and Warner Road.

After I moved my bike back to the sidewalk the piggy followed me with his motorcycle which he rode onto the sidewalk.

The light was green, but this is the first time I every hear a pig tell me that I had to obey the silly no walk sign.

To be honest I don't know what the sign said. I do know the light was green and I had the right of way and the piggy didn't give it to me when he made his left turn.

Oh well, looks like I will be suing the Chandler pigs this time.

I was only arrested for 60 seconds or so. No biggy. But the jack booted police thugs should still know better then to falsely arrest people for trivial things.

Arizona laws on bicycles

28-646. Pedestrian control signals; loitering prohibited

A. If special pedestrian control signals exhibiting the words "walk" or "don't walk" or a symbol of a walking person that symbolizes the word "walk" or a symbol of an upraised hand that symbolizes the words "don't walk" are in place, the signals shall indicate as follows:

1. Walk or a symbol of a walking person. Pedestrians facing the signal may proceed across the roadway in the direction of the signal and shall be given the right-of-way by the drivers of vehicles.

2. Don't walk or a symbol of an upraised hand. A pedestrian shall not start to cross the roadway in the direction of the signal, but a pedestrian who has partially completed crossing on the walk signal shall proceed to a sidewalk or safety island while the don't walk signal is showing.

B. A pedestrian shall not loiter or unduly delay crossing the roadway after traffic has stopped to give the right-of-way.

28-796. Pedestrian on roadways

A. If sidewalks are provided, a pedestrian shall not walk along and on an adjacent roadway.

B. If sidewalks are not provided, a pedestrian walking along and on a highway shall walk when practicable only on the left side of the roadway or its shoulder facing traffic that may approach from the opposite direction.

C. A person shall not stand in a roadway for the purpose of soliciting a ride from the driver of a vehicle.

28-815. Riding on roadway and bicycle path; bicycle path usage

A. A person riding a bicycle on a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as close as practicable to the right-hand curb or edge of the roadway, except under any of the following situations:

1. If overtaking and passing another bicycle or vehicle proceeding in the same direction.

2. If preparing for a left turn at an intersection or into a private road or driveway.

3. If reasonably necessary to avoid conditions, including fixed or moving objects, parked or moving vehicles, bicycles, pedestrians, animals or surface hazards.

4. If the lane in which the person is operating the bicycle is too narrow for a bicycle and a vehicle to travel safely side by side within the lane.

B. Persons riding bicycles on a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.

C. A path or lane that is designated as a bicycle path or lane by state or local authorities is for the exclusive use of bicycles even though other uses are permitted pursuant to subsection D or are otherwise permitted by state or local authorities.

D. A person shall not operate, stop, park or leave standing a vehicle in a path or lane designated as a bicycle path or lane by a state or local authority except in the case of emergency or for crossing the path or lane to gain access to a public or private road or driveway.

E. Subsection D does not prohibit the use of the path or lane by the appropriate local authority.

28-101. Definitions

6. "Bicycle" means a device, including a racing wheelchair, that is propelled by human power and on which a person may ride and that has either:

(a) Two tandem wheels, either of which is more than sixteen inches in diameter.

(b) Three wheels in contact with the ground, any of which is more than sixteen inches in diameter.

41. "Pedestrian" means any person afoot. A person who uses an electric personal assistive mobility device or a manual or motorized wheelchair is considered a pedestrian unless the manual wheelchair qualifies as a bicycle. For the purposes of this paragraph, "motorized wheelchair" means a self-propelled wheelchair that is used by a person for mobility.

28-817. Bicycle equipment

A. A bicycle that is used at nighttime shall have a lamp on the front that emits a white light visible from a distance of at least five hundred feet to the front and a red reflector on the rear of a type that is approved by the department and that is visible from all distances from fifty feet to three hundred feet to the rear when the reflector is directly in front of lawful upper beams of head lamps on a motor vehicle. A bicycle may have a lamp that emits a red light visible from a distance of five hundred feet to the rear in addition to the red reflector.

B. A person shall not operate a bicycle that is equipped with a siren or whistle.

C. A bicycle shall be equipped with a brake that enables the operator to make the braked wheels skid on dry, level, clean pavement.

28-812. Applicability of traffic laws to bicycle riders

A person riding a bicycle on a roadway or on a shoulder adjoining a roadway is granted all of the rights and is subject to all of the duties applicable to the driver of a vehicle by this chapter and chapters 4 and 5 of this title, except special rules in this article and except provisions of this chapter and chapters 4 and 5 of this title that by their nature can have no application.

28-922. Lighted lamps required

At any time from sunset to sunrise and at any other time when there is not sufficient light to render clearly discernible persons and vehicles on the highway at a distance of five hundred feet ahead, a vehicle on a highway in this state shall display lighted lamps and illuminating devices as required by this article for different classes of vehicles, subject to exceptions for parked vehicles as provided in this article.

The following definitions shall apply in the interpretation and enforcement of this chapter:

Authorized agent. The Chief of Police/designee, or any person or business granted authority by the Chief of Police to register a bicycle.

Bicycle. A device propelled by human power which any person may ride, having two (2) tandem wheels either of which is more than sixteen (16) inches in diameter or having three (3) wheels in contact with the ground any of which is more than sixteen (16) inches in diameter.

13-2. - Responsibility of parent.
The parent of a child and the guardian of a ward shall not authorize or knowingly permit the child or ward to violate any provisions of this chapter.

13-3. - Application of provisions.
The regulations of this chapter in their application to bicycles shall apply when a bicycle is operated upon any street, alley, highway, bicycle path or side walk subject to those exceptions stated in this chapter.

13-4. - Registration.
Every owner of a bicycle, before the same shall be operated on any of the streets, alleys, sidewalks or public highways in the City, is encouraged to register the bicycle with an authorized agent of the City.

13-4.1. License decals and registration. The City shall provide the license decals, which shall be affixed to the bicycle and shall remain affixed to the bicycle. The Police Department, or its authorized agent, shall keep a record of the date of issuance of each license, the person to whom issued and the number thereof.

13-4.2. Fees. There shall be no fee charged to register and obtain a license for a bicycle.

13-4.3. Duration. The registration provided for in this chapter shall be valid for the life of the bicycle. All bicycle registrations shall be appurtenant to the specific bicycle for which issued, and no other, and shall not be transferred to or used on any other bicycle.

13-4.4. Dealers of new or secondhand bicycles shall, prior to selling same to anyone residing within the City, inform the purchaser of the provisions of this chapter. This chapter shall in no way interfere with the secondhand dealer's responsibility pursuant to Chapter 15 of this City Code.

13-5. - Destruction of identifying numbers prohibited.
No person shall remove, destroy, mutilate or alter any number on the bicycle frame or any license plate, seal, decal or registration card. Nothing in this section shall prohibit the Police Department, or its authorized agent, from stamping identifying symbols, letters or numbers on the frames of bicycles.

13-7. - Report of sales and transfers by owners.

Every person who sells or transfers ownership of any bicycle which is registered with the City should report such sale or transfer to the Police Department. The original license decal, which has no expiration date, shall remain on the bicycle and the number reassigned to the new registered owner.

13-8. - Operations.
13-8.1. Pedestrian right-of-way. Whenever any person is riding a bicycle upon a sidewalk, where bicycle riding is not prohibited, they shall yield the right-of-way to any pedestrian.
13-8.2. Parking of bicycles. Bicycles may be parked in or near the public street right-of-way only under the following conditions or circumstances:
A. Upon the roadway against the curb.
B. Upon the sidewalk in a rack to support the bicycle.
C. Against a building.
D. At the curb, out of the roadway, in such a manner as to afford the least obstruction to pedestrian traffic.

When you look at the photos you will notice that there are cameras on the traffic signals so I suspect this means the city of Chandler shot some photos of the false arrest with their photo radar spy cameras.
